As the first port of call for many injuries and diseases, we rely on our General Practitioners (GPs) to properly assess the full range of potential diagnoses, identify those that may be relevant and treat or refer us to specialists accordingly.

As with all clinical negligence claims, even where the initial signs and symptoms may seem relatively benign, the effects of any delay or failure in treatment on the part of doctors can be devastating. Examples of GP compensation claims in which Penningtons Manches has advised include:

  • failure to correctly investigate and diagnose
  • failure to refer appropriately for further investigation and treatment
  • failure to act appropriately on the results of investigations
  • failure to take adequate precautions to avoid instances of further infection

Negligent delay in diagnosing breast cancer

Successfully settling a claim against our client’s GP for failing to carry out a proper examination and referral on a lump in her breast. When finally referred, cancer was diagnosed and she underwent a full mastectomy and chemotherapy.


Mismanagement of ear infection

Settling a substantial claim for damages against a GP for an 11 year old client who suffered permanent visual disability following a delay in the management of an ear infection which included a failure to prescribe anti-biotics.


Brain damage following a heart attack

Winning a claim for a client whose GP failed to diagnose his chest pains as a heart attack. He subsequently collapsed in the street. and the delay in his resuscitation led to brain damage.
