David Niven, Partner at Penningtons Manches

Profile

David is a partner in our commercial dispute resolution team and leads the professional negligence practice. He joined Penningtons Manches Cooper from Wedlake Saint in 2011, having qualified as a solicitor in 1985 with a magic circle law firm.

He specialises in all aspects of dispute resolution and increasingly acts for claimants in high value, multi-party actions against solicitors and other professionals. He is currently advising on a claim for more than 90 prospective purchasers of holiday homes in failed property developments in Calabria, Italy. This case has several reported judgments covering interesting legal points and has received national press coverage. David is also acting for over 200 clients in four further substantial group action claims against solicitors following other unsuccessful off plan property investment schemes with losses of several million pounds.

Additionally, David has strong expertise in transport regulatory work, including representing clients at public inquiries and advising goods vehicle and passenger service operators on regulatory matters and road traffic prosecutions. A committee member of both the London and South Eastern Coach Passenger Transport Association and the Freight Transport Association’s Greater London Freight Council, he holds a Certificate of Professional Competence.

David is recommended in The Legal 500 as ‘top notch’.

Recent work highlights

  • Recovering substantial sums in a “no win no fee” case for several claimants against their former solicitors who had been negligent.
  • Advising on multi-million pound professional negligence claims for private individuals against their former solicitors.
  • Representing a coach company, its insurer and the driver after a fatal accident in London involving a cyclist. Liaising with the police, we avoided criminal proceedings and resisted a civil damages claim from the cyclist’s family.
  • Successfully challenging a competitor’s use of a web domain name to divert business away from our coach company client by securing an interim injunction and applying to Nominet to transfer the domain name to our client.
  • Securing an asset freezing injunction to protect our client in advance of a fee fraud claim.
  • Considerable expertise advising in relation to misselling of swaps by Banks.
