Philip Barth, partner and head of the immigration team at Penningtons Solicitors LLP, has successfully negotiated the reinstatement of the sponsor licence of a private college in the education sector.
The college came to Penningtons in February for assistance after it received a notice of suspension of its sponsor licence, with the implicit threat of revocation of its licence if it was not able to address the concerns of the UKBA about its compliance efforts.
After carrying out our own assessment of the college's compliance regime, we sent a judicial review pre-action protocol letter threatening to challenge the suspension in the High Court. This triggered a further inspection visit by UKBA officials following which Philip Barth made further representations and succeeded by early March in having the suspension lifted without the need to issue court proceedings.
