Chambers UK
Holiday Accident

Penningtons Manches Cooper's travel law team has an excellent success record of obtaining damages for clients who have suffered accidents, injuries and illness while on a package holiday.

The Package Travel and Linked Travel Arrangements Regulations 2018 allow an injured holidaymaker to pursue a compensation claim against a tour operator in the UK courts. This is possible if the accident or illness is caused because the tour operator or its supplier fails to properly perform the package holiday contract. A typical example would be if a hotel does not comply with local safety standards and this failure causes you to have an accident.

A claim against a tour operator is based on a breach of contract and is subject to English law. This means that you are entitled to recover damages based on English law rather than the law of the country where the accident occurred. This is often beneficial because English damages awards are usually higher than those given in other countries.

Our extensive network of personal injury lawyers throughout the world gives us access to reliable advice on local standards and regulations. This helps us to advise you at an early stage about the prospects of a successful claim against the tour operator.

We also have a high profile within the insurance industry and were awarded the International Travel Insurance Journal (ITIJ) award for Legal Services Provider of the Year in 2012.

Initial advice is offered free of charge and without obligation. This can include guidance over the telephone, a visit from one of our specialist solicitors or a review of your documents. We offer various forms of funding, including no win no fee (conditional fee) agreements. Our team aims to ensure that you receive maximum compensation while minimising the legal costs involved.
