Supermarket defects


We acted for the institutional owner of part of a large shopping centre in Sussex. Our client had taken an assignment of the original building contract for the entire development but had to enforce the contract if required by the owner of the other part (a supermarket chain) in any case where there was an issue concerning that part of the centre.

We advised our client on its legal position in a long running dispute between the supermarket and the contractor over defects within the supermarket’s part of the building. This included the negotiation of a multi-party compromise agreement to resolve the claim.

Subsequently new claims have arisen in our client’s own part of the building and we have advised on and represented our client in bringing these claims under the building contract.
