Negotiating a settlement for private hospital dispute


The owners of a private hospital asked us to advise on disputes relating to the design and installation of a specialist metal roof as part of a new build construction. We represented the hospital in negotiations with the contractor and the contractor’s consultant. The dispute was about the contractor’s responsibility for the detailing of certain features of the roof which had been carried out by a specialist subcontractor.

We reviewed the contract documents and advised the client on the extent of the contractor's responsibilities under the contract for design. We advised the client on the need for an expert’s report and the specific questions it needed to focus on. We reviewed the final draft of the report and drafted letters of claim setting out the legal case. Subsequently, we advised on the terms of a settlement agreed with the contractor.
