Destruction of embryos in error

A member of our team advised a couple who had previously undergone fertility treatment at a private fertility clinic. Several embryos were frozen for future treatment but soon after, due to an administrative error, the embryos were destroyed against the wishes of the couple.

With the assistance of expert evidence, our clinical negligence specialist was able to establish that the treatment with those embryos would have led to the successful birth of a baby and, as a result, the couple recovered substantial damages to fund future IVF treatment.
