Nichola Carter, who heads Penningtons' immigraton team, is quoted in today's edition of the Law Society Gazette in an article which examines action taken by the UK Border Agency (UKBA) against educational institutions.
The UKBA sent letters to education providers in which it threatened to withhold their power to sponsor foreign students under the points based system unless they stopped issuing confirmations of acceptance for study to students with immediate effect and met with the UKBA.
Penningtons wrote to the UKBA to point out that this action breached the immigraton rules and that clients who had been contacted by the UKBA felt threatened by the correspondence.
As a result of the UKBA action, some of its officials could face misfeasance actions.
